Mumbai’s Pollution Surpassing Delhi an ‘Emergency’, Asks Bombay High Court; Warns Officials

1

The Bombay High Court on Wednesday expressed serious concern over Mumbai’s deteriorating air quality, describing it as “shocking” that the city was surpassing Delhi in pollution levels. The court also pulled up civic authorities, pollution control officials and the police over their failure to effectively enforce orders aimed at curbing air and noise pollution during festivities.

Questioning the authorities’ lack of enforcement, the court asked how officials responsible for implementing pollution-control measures could have a “peaceful sleep” despite what it described as an “emergency situation” in which lakhs of residents were suffering the ill-effects of pollution.

The court warned that officials could be held accountable for dereliction of duty if they failed to carry out their responsibilities.

The observations highlight the judiciary’s growing concern over the impact of worsening pollution on public health and the failure of enforcement agencies to ensure compliance with existing directions.

The court’s criticism comes amid mounting concerns over air quality in Mumbai, where rising pollution levels have raised questions about the effectiveness of measures taken by authorities to protect residents.

By questioning the accountability of civic bodies, pollution control agencies and the police, the High Court emphasised the need for officials to take their responsibilities seriously and ensure that existing orders are implemented on the ground.

The court’s warning also puts the spotlight on enforcement during festive periods, when noise and air pollution can intensify. Its observations signal that authorities may face scrutiny if they fail to act against violations and protect the public from the harmful effects of pollution.
